These documents govern the use of the Legacy Live platform. Please read them carefully before using our services.
Legacy Live Pty Ltd (ACN 699 501 301 | ABN 29 699 501 301) ("Legacy Live," "the Company," "we," "us," "our") provides a managed Software-as-a-Service (SaaS) platform for livestreaming, recording and private viewing of funerals, memorials, weddings, baptisms, celebrations and other supported bookings. The platform also includes AI-powered features including an in-platform support assistant and automated analytics agents that assist with account management and operational insights.
These Terms and Conditions ("Terms") form a binding legal agreement between Legacy Live and any account holder, funeral director, church, chapel, celebrant, venue, AV provider, corporate entity or individual ("User," "you," "your") who accesses or uses the Legacy Live platform, dashboard, or associated services.
Legacy Live supplies platform infrastructure only. It does not grant music, copyright, performance, recording, communication, synchronisation or other content rights. You remain responsible for ensuring the business that produces or delivers each booking holds the permissions required for its particular content and delivery method.
By creating an account, clicking "I Agree," or using any part of the platform, you agree to be bound by these Terms. If you do not agree, do not use the service.
The Legacy Live platform includes an optional "Require Approval" workflow that account administrators may enable in their settings. When enabled, no livestream can commence until an authorised account administrator has reviewed and activated the booking. This feature is available on all subscription tiers and is recommended as a safeguard against unauthorised streaming.
Regardless of whether the approval workflow is enabled on your account, all other obligations in this section — including consent, compliance with surveillance laws, and signage requirements — apply at all times.
By commencing a live stream through the platform, you make the following certifications to Legacy Live:
Livestreaming may involve optical and listening devices. Surveillance, privacy, workplace, venue and recording requirements differ between Australian States and Territories and may depend on the venue, the people recorded and the way the stream is shared. The Surveillance Devices Act 2007 (NSW) is one example of State legislation that may apply to a New South Wales booking.
The sole responsibility for ensuring lawful operation rests with you. This includes, where appropriate:
We strongly recommend that you maintain written records of the authority, permissions and notices relevant to each booking. Legacy Live's activity logs record which user started a stream and when, but do not constitute evidence of third-party consent.
Successful delivery of a livestream is dependent on the availability and quality of the internet connection at the streaming venue. Legacy Live provides an integrated Network Health Speedometer within the Stream Hub to help you verify local upload bandwidth before each booking.
Our recommended minimum upload bandwidth is 4.5 Mbps for standard HD streaming. For higher-quality streams or multi-camera setups, we recommend 8 Mbps or above.
Legacy Live maintains its hosting infrastructure on Australian-based servers and works to ensure maximum platform availability. However, consistent with Australian Consumer Law (ACL), we are not liable for service interruptions caused by factors outside our direct control, including:
You agree that Legacy Live's internal Agent Activity Logs and Network Health Logs, as recorded on our servers and accessible to Super Administrators, shall serve as the authoritative and definitive record for determining the cause and duration of any service interruption, disputed stream event, or system anomaly.
These logs record, amongst other things: stream start and stop times, upload bandwidth readings, camera and microphone status events, approval timestamps, and automated agent actions.
Streams are automatically managed in accordance with the booked duration. The platform's monitoring system may issue email warnings before the booked end time and may automatically stop streams that exceed their booked duration by more than a configurable grace period. Streams running without a booking for longer than a platform-defined ceiling may also be automatically stopped. Excess stream usage beyond included monthly allowances is billed at the applicable excess rate in your subscription plan.
All software, code, user interface designs, logos, trademarks, and technology constituting the Legacy Live platform are and remain the intellectual property of Legacy Live Pty Ltd. Nothing in these Terms transfers any ownership rights in the platform to you.
All video recordings, uploaded media, guest-book or condolence messages, and other content generated through your use of the platform ("Your Content") remains the property of you and/or the relevant rights holder as appropriate. Legacy Live claims no ownership over Your Content.
By uploading or streaming content through the platform, you grant Legacy Live a limited, non-exclusive, royalty-free licence to host, store, transmit, and display Your Content solely for the purpose of providing the service to you. This licence terminates upon deletion of the content or termination of your account.
You warrant that Your Content does not infringe the intellectual property, privacy, or other rights of any third party. You indemnify Legacy Live against any claim arising from content you upload or stream.
You must provide accurate, current, and complete information when creating an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
Legacy Live offers tiered subscription plans as published on our pricing page. A plan's included stream allowance may be used across any supported funeral or event booking category. Subscriptions are billed monthly or annually in Australian Dollars (AUD) unless otherwise agreed in writing. All pricing is exclusive of GST unless stated otherwise. Where GST applies, it will be added at checkout and a tax invoice issued.
Payment is processed by Stripe Inc., a PCI-compliant payment processor. Legacy Live does not store your full card details. By subscribing, you authorise automatic recurring charges on your nominated payment method.
Monthly subscription fees are non-refundable except where required by the ACL. If you believe you have been charged in error, contact us within 30 days of the charge and we will investigate promptly.
We reserve the right to suspend access to the platform if payment fails after a reasonable grace period. We will provide notice before suspension wherever possible.
You agree not to use the Legacy Live platform to:
Violation of this Acceptable Use Policy may result in immediate suspension or termination of your account without refund.
You may cancel your subscription at any time through the Billing section of your account settings. Cancellation takes effect at the end of your current billing period. Your booking content, including recordings, uploaded media and booking data, will remain accessible for 30 days following cancellation, after which it may be permanently deleted. Account information (business details, billing history and activity logs) is retained for legal and compliance purposes in accordance with the retention schedule in our Privacy Policy.
Legacy Live may terminate or suspend your account with or without notice if:
Upon termination, your right to access the platform ceases immediately. We will make your content available for export for 30 days upon request. After this period, all data associated with your account may be permanently deleted.
Nothing in these Terms excludes, restricts, or modifies any right or remedy, or any guarantee, warranty, or other term or condition, implied or imposed by the Australian Consumer Law that cannot lawfully be excluded or limited.
To the maximum extent permitted by law, Legacy Live's total aggregate liability to you for any loss or damage arising in connection with these Terms or the platform is limited to the greater of:

If a dispute arises in connection with these Terms, the parties agree to first attempt to resolve it in good faith by providing written notice of the dispute and engaging in direct negotiations for a period of 30 days.
If negotiation fails, either party may refer the dispute to mediation administered by the Australian Disputes Centre (ADC) or a mutually agreed mediator.
These Terms are governed by the laws of New South Wales, Australia. Each party irrevocably submits to the exclusive jurisdiction of the courts of New South Wales.
Legacy Live may update these Terms from time to time. We will provide at least 14 days' notice of material changes via email or an in-platform notification. Continued use of the platform after the notice period constitutes acceptance of the updated Terms.
These Terms, together with the Privacy Policy and any applicable order form or subscription agreement, constitute the entire agreement between you and Legacy Live and supersede all prior discussions.
If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force and effect.

We recognise that livestreamed funerals, memorials, weddings, baptisms, celebrations and other events can involve highly personal moments and personal information. We treat this responsibility with the seriousness it deserves.
This Privacy Policy explains what personal information we collect, how we use it, who we share it with, and how you can access, correct, or request deletion of your information.
Music and other copyright permissions are content-rights matters rather than privacy permissions. Legacy Live does not provide those rights; account holders remain responsible for the content they record or deliver. This information is entered by you as the account holder and is not ordinarily collected directly from families, organisers or participants by Legacy Live. You must only provide information that you are authorised to provide.
Our platform automatically collects technical data including:
Video recordings, photographs, memorial media, event media and uploaded documents ("Booking Media") may be stored in Firebase Storage on Google's Australian infrastructure. This media is associated with a specific booking and is governed by the access controls you configure.
Family members, friends and community members may submit a condolence or guest-book message through a public viewer page associated with a booking. When a message is submitted, we collect:
This information is collected on behalf of the account holder operating the booking. Messages are stored with that booking and may be accessible to the account holder and to viewers of the associated public page, as disclosed at the time of collection.
Message submitters who wish to have a message removed may contact the account holder directly, or contact us at admin@legacylive.com.au. We will process valid removal requests within 30 days.
Each booking on the Legacy Live platform is assigned a unique, randomly generated identifier. Media, guest-book or condolence messages, stream data and associated metadata for one booking are logically isolated from other bookings within your account and across the platform.
This architecture is designed to reduce unintended exposure of one booking's information to another and to ensure that access to one booking does not grant access to others.
Live video data transmitted through the Legacy Live platform is encrypted in transit via the Agora RTC network. All other data transmitted between your browser and our servers uses TLS 1.2 or higher.
Data stored in Firebase Firestore and Firebase Storage is encrypted at rest using AES-256 encryption, managed by Google Cloud's infrastructure.
Access to your account data is controlled by Firebase Authentication. Staff members can only access locations and bookings assigned to them by your account administrator. Legacy Live staff access to customer data is restricted to authorised personnel for support and operational purposes only, and is logged.
Funerals, religious ceremonies and events may involve sensitive information as defined under the Privacy Act 1988, including religious beliefs, ethnic or cultural background, and in some funeral contexts, health information relating to the cause of death. You should avoid entering sensitive information unless it is reasonably necessary for the booking and you are authorised to provide it.
Sensitive information entered into the platform is collected and processed solely to deliver the livestreaming, recording and associated viewer experience for that specific booking. We do not use sensitive information for secondary purposes, including profiling, analytics or product development, without appropriate authority or consent.
Legacy Live does not sell, rent, or share any personal information — including sensitive information — with third-party advertisers or data brokers. We do not use your data or the data of the families you serve for targeted advertising purposes.
Funerals, weddings, baptisms and other events may involve the recording or streaming of minors. Legacy Live does not directly collect personal information from children through its public pages. The account holder is responsible for determining and obtaining any parent, guardian, school, venue or organiser authority required before intentionally featuring or identifying a minor in a booking.
Legacy Live staff who may access personal information in the course of providing technical support are bound by confidentiality obligations. All staff with data access receive privacy training and are subject to disciplinary action for misuse of personal information.
Legacy Live does not sell personal information. We may disclose personal information to the following third-party service providers strictly for the purposes of delivering our platform:

We require all third-party service providers to maintain appropriate data security standards and to process personal information only in accordance with our instructions and applicable law.
Legacy Live sends transactional and operational emails to account holders, including stream alerts, booking notifications, system health reports, and billing communications. These messages are sent in accordance with the Spam Act 2003 (Cth). Each email identifies the sender and, where applicable, includes an option to adjust notification preferences through your account settings. We do not send unsolicited commercial electronic messages.
We may disclose personal information if required to do so by law, court order, or a lawful request from a government authority. Where possible and lawful, we will notify you before making such a disclosure.
We retain personal information for as long as necessary to provide the service and comply with our legal obligations. Our general retention schedule is:
You have the right to access the personal information we hold about you and to request corrections if it is inaccurate, incomplete, or out of date. Requests can be made through your account settings or by contacting us at admin@legacylive.com.au. We will respond within 30 days.
A family member, organiser or participant may request the permanent removal of video recordings, Booking Media, or a guest-book or condolence message associated with a booking. As the account holder, you agree to:
Legacy Live will permanently delete the requested content within 30 days of a confirmed deletion request. Certain activity log entries may be retained for the standard log retention period even after content deletion.
Legacy Live complies with the Notifiable Data Breaches (NDB) scheme under Part IIIC of the Privacy Act 1988 (Cth). In the event of an eligible data breach — one that is likely to result in serious harm to any individual whose information is involved — Legacy Live will:
We maintain an internal data breach response procedure and conduct regular security assessments to minimise the risk of a breach occurring.
If you believe we have breached the Australian Privacy Principles, you may lodge a complaint with us in writing. We will acknowledge your complaint within 5 business days and provide a substantive response within 30 days. If you are unsatisfied with our response, you may escalate your complaint to the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au.
The Legacy Live platform uses cookies and similar tracking technologies for the following purposes:

While our primary infrastructure is Australian-hosted, some service providers operate globally and may process data on servers outside Australia:
Before disclosing personal information to overseas recipients, Legacy Live takes reasonable steps to ensure that the overseas recipient is subject to a law, binding scheme, or contract that provides privacy protections substantially similar to the APPs, consistent with APP 8.1 of the Privacy Act.
Legacy Live may use anonymised, aggregated, non-identifiable data derived from platform usage for industry reporting, benchmarking and research purposes. No individual booking, operator, family member, participant or deceased person is identifiable in any report or dataset produced. Raw personal information is never shared with third parties for this purpose.

These aggregated datasets are produced by combining data from many bookings and operators such that no individual account holder, booking, family or person can be identified. Legacy Live applies statistical techniques, including minimum cohort thresholds and data suppression, before any dataset is published or shared.
