These documents govern the use of the Legacy Live platform. Please read them carefully before using our services.
BG Digital Solutions Pty Ltd (ABN 63 343 272 486), trading as Legacy Live ("Legacy Live," "the Company," "we," "us," "our"), is an Australian technology company providing a managed Software-as-a-Service (SaaS) platform for the live streaming, recording, and digital memorialization of funeral and memorial services.
These Terms and Conditions ("Terms") form a binding legal agreement between Legacy Live and any Funeral Director, Chapel, Corporate Entity, or individual ("User," "you," "your") who accesses or uses the Legacy Live platform, dashboard, or any associated services.
By creating an account, clicking "I Agree," or using any part of the platform, you agree to be bound by these Terms. If you do not agree, do not use the service.
The Legacy Live platform includes an optional "Require Approval" workflow that account administrators may enable in their settings. When enabled, no live stream can commence for a service until an authorised account administrator has reviewed the booking and activated it. This feature is available on all subscription tiers and is recommended as a safeguard against unauthorised streaming.
Regardless of whether the approval workflow is enabled on your account, all other obligations in this section — including consent, compliance with surveillance laws, and signage requirements — apply at all times.
By commencing a live stream through the platform, you make the following certifications to Legacy Live:
You acknowledge and agree that live streaming a funeral or memorial service involves the use of optical and listening devices as contemplated by the Surveillance Devices Act 2004 (Cth), the Surveillance Devices Act 2007 (NSW), and equivalent State and Territory legislation across Australia.
The sole responsibility for ensuring lawful operation rests with you. This includes, without limitation:
We strongly recommend that you maintain your own written records of consent obtained from families. Legacy Live's activity logs record which user started each stream and at what time, but these records do not constitute evidence of third-party consent.
Successful delivery of a live stream is dependent on the availability and quality of the internet connection at the streaming venue. Legacy Live provides an integrated Network Health Speedometer within the Stream Hub to help you verify local upload bandwidth prior to each service.
Our recommended minimum upload bandwidth is 4.5 Mbps for standard HD streaming. For higher-quality streams or multi-camera setups, we recommend 8 Mbps or above.
Legacy Live maintains its hosting infrastructure on Australian-based servers and works to ensure maximum platform availability. However, consistent with Australian Consumer Law (ACL), we are not liable for service interruptions caused by factors outside our direct control, including:
You agree that Legacy Live's internal Agent Activity Logs and Network Health Logs, as recorded on our servers and accessible to Super Administrators, shall serve as the authoritative and definitive record for determining the cause and duration of any service interruption, disputed stream event, or system anomaly.
These logs record, amongst other things: stream start and stop times, upload bandwidth readings, camera and microphone status events, approval timestamps, and automated agent actions.
Streams are automatically managed in accordance with the booked service duration. The platform's monitoring system will issue email warnings at approximately 10 minutes before the booked end time, and a final warning when the booked time has elapsed. Streams that exceed their booked duration by more than a configurable grace period may be automatically stopped by our monitoring system. Streams running without a service booking for longer than a platform-defined ceiling will also be automatically stopped. Excess stream usage beyond included monthly allowances is billed at the applicable excess rate in your subscription plan.
All software, code, user interface designs, logos, trademarks, and technology constituting the Legacy Live platform are and remain the intellectual property of BG Digital Solutions Pty Ltd trading as Legacy Live. Nothing in these Terms transfers any ownership rights in the platform to you.
All video recordings, memorial media, condolence messages, and content generated through your use of the platform ("Your Content") remains the property of you and/or the relevant family as appropriate. Legacy Live claims no ownership over Your Content.
By uploading or streaming content through the platform, you grant Legacy Live a limited, non-exclusive, royalty-free licence to host, store, transmit, and display Your Content solely for the purpose of providing the service to you. This licence terminates upon deletion of the content or termination of your account.
You warrant that Your Content does not infringe the intellectual property, privacy, or other rights of any third party. You indemnify Legacy Live against any claim arising from content you upload or stream.
You must provide accurate, current, and complete information when creating an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
Legacy Live offers tiered subscription plans as published on our pricing page. Subscriptions are billed monthly or annually in Australian Dollars (AUD) unless otherwise agreed in writing. All pricing is exclusive of GST unless stated otherwise. Where GST applies, it will be added at checkout and a tax invoice issued.
Payment is processed by Stripe Inc., a PCI-compliant payment processor. Legacy Live does not store your full card details. By subscribing, you authorise automatic recurring charges on your nominated payment method.
Monthly subscription fees are non-refundable except where required by the ACL. If you believe you have been charged in error, contact us within 30 days of the charge and we will investigate promptly.
We reserve the right to suspend access to the platform if payment fails after a reasonable grace period. We will provide notice before suspension wherever possible.
You agree not to use the Legacy Live platform to:
Violation of this Acceptable Use Policy may result in immediate suspension or termination of your account without refund.
You may cancel your subscription at any time through the Billing section of your account settings. Cancellation takes effect at the end of your current billing period. Your data will be retained for 30 days following cancellation, after which it may be permanently deleted.
Legacy Live may terminate or suspend your account with or without notice if:
Upon termination, your right to access the platform ceases immediately. We will make your content available for export for 30 days upon request. After this period, all data associated with your account may be permanently deleted.
Nothing in these Terms excludes, restricts, or modifies any right or remedy, or any guarantee, warranty, or other term or condition, implied or imposed by the Australian Consumer Law that cannot lawfully be excluded or limited.
To the maximum extent permitted by law, Legacy Live's total aggregate liability to you for any loss or damage arising in connection with these Terms or the platform is limited to the greater of:

If a dispute arises in connection with these Terms, the parties agree to first attempt to resolve it in good faith by providing written notice of the dispute and engaging in direct negotiations for a period of 30 days.
If negotiation fails, either party may refer the dispute to mediation administered by the Australian Disputes Centre (ADC) or a mutually agreed mediator.
These Terms are governed by the laws of New South Wales, Australia. Each party irrevocably submits to the exclusive jurisdiction of the courts of New South Wales.
Legacy Live may update these Terms from time to time. We will provide at least 14 days' notice of material changes via email or an in-platform notification. Continued use of the platform after the notice period constitutes acceptance of the updated Terms.
These Terms, together with the Privacy Policy and any applicable order form or subscription agreement, constitute the entire agreement between you and Legacy Live and supersede all prior discussions.
If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force and effect.

We recognise that the nature of our service — facilitating the streaming and digital memorialization of funeral services — means we may handle some of the most personal and sensitive moments of people's lives. We treat this responsibility with the seriousness it deserves.

Our platform automatically collects technical data including:
Video recordings, photographs, and memorial videos ("Memorial Media") uploaded to or generated by the platform are stored in Firebase Storage on Google's Australian infrastructure. This media is associated with a specific service booking and is governed by the access controls you configure.
Family members, friends, and community members may submit condolence messages through the public viewer page associated with a service. When a condolence message is submitted, we collect:
This information is collected on behalf of the funeral home operating the service. Condolence messages are stored in association with the specific service booking and are accessible to the account holder (funeral home) and to other viewers of that service's condolence page via a shared link. Submitters are notified of this at the time of collection.
Condolence submitters who wish to have their message removed may contact the funeral home directly, or contact us at admin@legacylive.com.au. We will process removal requests within 30 days.
Each memorial service on the Legacy Live platform is assigned a unique, randomly generated identifier. All media, condolence messages, stream data, and associated metadata for one service are technically isolated from all other services within your account and across the platform.
This architecture is designed to prevent data bleeding — the unintentional exposure of one family's information to another — and to ensure that access to any one service does not grant access to others.
Live video data transmitted through the Legacy Live platform is encrypted in transit via the Agora RTC network. All other data transmitted between your browser and our servers uses TLS 1.2 or higher.
Data stored in Firebase Firestore and Firebase Storage is encrypted at rest using AES-256 encryption, managed by Google Cloud's infrastructure.
Access to your account data is controlled by Firebase Authentication. Staff members can only access locations and services assigned to them by your account administrator. Legacy Live staff access to customer data is restricted to authorised personnel for support and operational purposes only, and is logged.
We recognise that funeral services often involve "sensitive information" as defined under the Privacy Act 1988, including information about a person's religious beliefs, ethnic or cultural background, and in some cases, health information relating to the cause of death.
Sensitive information entered into the platform is collected and processed solely for the purpose of delivering the live streaming and digital memorialization service for that specific booking. We do not use sensitive information for any secondary purpose, including profiling, analytics, or product development, without your explicit consent.
Legacy Live does not sell, rent, or share any personal information — including sensitive information — with third-party advertisers or data brokers. We do not use your data or the data of the families you serve for targeted advertising purposes.
Funeral and memorial services may involve the recording and streaming of minors who are in attendance. Legacy Live does not directly collect personal information from children. The funeral home, as the account holder, is responsible for ensuring appropriate consent has been obtained from parents or guardians for the recording of any minors attending the service.
Legacy Live staff who may access personal information in the course of providing technical support are bound by confidentiality obligations. All staff with data access receive privacy training and are subject to disciplinary action for misuse of personal information.
Legacy Live does not sell personal information. We may disclose personal information to the following third-party service providers strictly for the purposes of delivering our platform:

We require all third-party service providers to maintain appropriate data security standards and to process personal information only in accordance with our instructions and applicable law.
Legacy Live sends transactional and operational emails to account holders, including stream alerts, booking notifications, system health reports, and billing communications. These messages are sent in accordance with the Spam Act 2003 (Cth). Each email identifies the sender and, where applicable, includes an option to adjust notification preferences through your account settings. We do not send unsolicited commercial electronic messages.
We may disclose personal information if required to do so by law, court order, or a lawful request from a government authority. Where possible and lawful, we will notify you before making such a disclosure.
We retain personal information for as long as necessary to provide the service and comply with our legal obligations. Our general retention schedule is:
You have the right to access the personal information we hold about you and to request corrections if it is inaccurate, incomplete, or out of date. Requests can be made through your account settings or by contacting us at admin@legacylive.com.au. We will respond within 30 days.
Families may request the permanent removal of video recordings, memorial media, or condolence messages associated with a service. As the account holder (funeral director or funeral home), you agree to:
Legacy Live will permanently delete the requested content within 30 days of a confirmed deletion request. Certain activity log entries may be retained for the standard log retention period even after content deletion.
Legacy Live complies with the Notifiable Data Breaches (NDB) scheme under Part IIIC of the Privacy Act 1988 (Cth). In the event of an eligible data breach — one that is likely to result in serious harm to any individual whose information is involved — Legacy Live will:
We maintain an internal data breach response procedure and conduct regular security assessments to minimise the risk of a breach occurring.
If you believe we have breached the Australian Privacy Principles, you may lodge a complaint with us in writing. We will acknowledge your complaint within 5 business days and provide a substantive response within 30 days. If you are unsatisfied with our response, you may escalate your complaint to the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au.

Before disclosing personal information to overseas recipients, Legacy Live takes reasonable steps to ensure that the overseas recipient is subject to a law, binding scheme, or contract that provides privacy protections substantially similar to the APPs, consistent with APP 8.1 of the Privacy Act.
